Being pulled over by law enforcement is a stressful experience for anyone. If the officer suspects you of driving under the influence, that stress can quickly become overwhelming. Knowing your rights and what to do in that moment can make a significant difference in the outcome of your case.

Be Polite and Comply with Basic Requests

You are required to provide your license, registration, and proof of insurance when asked. Be polite and cooperative with these basic requests. However, being cooperative does not mean you must answer every question asked of you.

You Have the Right to Remain Silent

You are not required to answer questions like "Have you been drinking tonight?" or "Where are you coming from?" Politely inform the officer that you are exercising your right to remain silent. Anything you say can and will be used against you in court.

Field Sobriety Tests Are Voluntary

In Maryland, field sobriety tests — walking a straight line, standing on one leg — are voluntary. You may decline them without penalty. These tests are highly subjective and are often used to build a case against you.

Breathalyzer Tests Are Different

Maryland's implied consent law means that by driving on Maryland roads, you have agreed to submit to a breathalyzer test if lawfully arrested. However, refusing to blow can actually help your DUI case by denying the State one of its most powerful pieces of evidence — your blood alcohol level. Without a breathalyzer result, prosecutors have a much harder time proving impairment beyond a reasonable doubt. The tradeoff is that refusing will likely result in an automatic license suspension. Whether refusing is the right call depends on the circumstances, and it is a decision best discussed with an attorney as early as possible.

Call an Attorney Immediately

As soon as possible, contact a criminal defense attorney. The earlier an attorney gets involved, the better positioned you are to challenge the stop, the test results, and any other evidence against you.

If you or someone you know has been charged with DUI in Cecil County, contact Grott Law immediately for a free consultation.
